1. Definitions

 “Company,” “We,” “Us,” or “Our”
Refers to D4PS Couriers and Logistics, the business providing courier and logistics services under these Terms and Conditions.

  “Customer,” “You,” or “Your”
Refers to the individual or entity that has agreed to the Terms and Conditions of D4PS Couriers and Logistics and uses the services provided by the Company.

“Services”
Refers to the courier, logistics, and transportation services provided by D4PS Couriers and Logistics, including, but not limited to, package delivery, freight transportation, storage, and supply chain management.

  “Shipment”
Refers to the goods or items that the Customer has entrusted to D4PS Couriers and Logistics for delivery, transportation, or storage.

  “Delivery”
Refers to the act of transporting a Shipment from the point of origin to the designated destination, as requested by the Customer.

  “Tracking Number”
A unique identifier assigned to each Shipment that allows the Customer to track its status and location throughout the delivery process.

  “Contract”
Refers to the agreement formed when the Customer accepts the terms outlined in the Terms and Conditions, including the booking or scheduling of Services provided by D4PS Couriers and Logistics.

  “Fees”
Refers to the charges or payments that the Customer agrees to pay to D4PS Couriers and Logistics for the Services rendered. This may include delivery charges, handling fees, storage costs, and any other applicable fees related to the services provided.

  “Late Delivery”
Refers to the situation where a Shipment is delivered later than the agreed or expected delivery time, excluding delays caused by Force Majeure or Customer-related issues.

  “Packaging”
Refers to the materials or containers in which goods are prepared for transport or storage, including but not limited to boxes, pallets, or crates.

  “Third-Party Providers”
Refers to any external companies or subcontractors engaged by D4PS Couriers and Logistics to assist with specific aspects of the Services, such as warehousing, delivery, or customs clearance.

  “Prohibited Items”
Refers to any goods or items that are not accepted for transport under the Services provided by D4PS Couriers and Logistics, as listed on the Company’s website or specified in the Terms and Conditions.

  “Account”
Refers to a registered user account created by the Customer for the purpose of booking, managing, and tracking shipments or services provided by D4PS Couriers and Logistics.

 2.General Terms

  • Agreement to Terms By using the services of D4PS Couriers and Logistics Ltd (referred to as “the Company,” “we,” “our,” or “us”), you (the “Customer,” “you,” or “your”) agree to comply with and be bound by these Terms and Conditions. If you do not agree with any part of these Terms, you must not use our services.
  • Modification of Terms the Company reserves the right to modify, amend, or update these Terms and Conditions at any time. Any changes will be communicated to customers by posting the revised Terms and Conditions on our website or via email. It is the Customer’s responsibility to review these Terms regularly.
  • Booking and Scheduling All bookings for services must be made in accordance with the booking process outlined on our website or app. The Company will make reasonable efforts to fulfil all booked services but is not liable for delays or cancellations caused by circumstances beyond our control (such as weather, traffic, or Force Majeure events

3.Consignment Terms

Definition of Consignment A Consignment refers to any goods, packages, or items entrusted to D4PS Couriers and Logistics Ltd for transportation, delivery, or storage. This includes, but is not limited to, parcels, freight, or shipments that are subject to the Company’s services.

3.1 Customer’s Responsibility
    • Proper Packaging: The Consignor (Customer) is responsible for properly packaging all consignments to ensure their safe transportation. The Company is not liable for any damage or loss resulting from insufficient or improper packaging.
    • Labelling: The Customer is responsible for ensuring that consignments are correctly labelled with the appropriate details, including the recipient’s name, address, contact details, and any special handling instructions.
    • Accuracy of Information: The Consignor must provide accurate, complete, and truthful information regarding the consignment, including its contents, weight, dimensions, and value. Failure to do so may result in delays, additional charges, or the refusal of the consignment.
 3.2 Prohibited and Restricted Items
  • The following items are prohibited from being shipped as consignments with D4PS Couriers and Logistics Ltd:
  • Hazardous materials or dangerous goods
  • Live animals (unless otherwise agreed upon)
  • Illegal or illicit substances
  • Perishable items that are not properly stored or packaged

Any items deemed unsafe or inappropriate for transport by the Company The Company reserves the right to refuse or cancel the consignment of any item that falls under these categories. 4.Charges

4.1 Pricing Structure

    • The fees for services provided by D4PS Couriers and Logistics Ltd (“the Company”) are based on the nature of the services requested, the size and weight of the consignment, the distance travelled, and any other relevant factors. Prices are subject to change at the Company’s discretion.
    • A detailed breakdown of the charges for specific services is available upon request.
    • All service charges will be based on the applicable rates at the time of booking.

5.Delivery

5.1 Delivery Services

D4PS Couriers and Logistics Ltd (“the Company”) offers various delivery services, including standard, expedited, and international delivery options. The delivery service selected by the Customer will be provided according to the terms and conditions specific to that service.

5.2 Delivery Timeframes

    • Estimated delivery times are provided at the time of booking. These timeframes are based on standard operational procedures, but the Company does not guarantee specific delivery times. Delivery times may vary due to factors such as distance, customs clearance, weather conditions, traffic, or Force Majeure events. We determine the best route and method for delivering your goods. However, if we need to make changes for efficiency or safety reason, we have the right to do so
    • For international shipments, delivery times are estimates and may be impacted by customs processes, local laws, and international regulations. The Company is not responsible for delays caused by customs inspections or other factors beyond its control.

5.3 Delivery Confirmation

  • The Company may require proof of delivery (such as a signature or photo confirmation) as evidence that the consignment has been successfully delivered. The Customer and recipient agree that this confirmation will constitute conclusive proof of delivery and acceptance of the goods.
  • In the case of signed deliveries, the signature of the recipient (or an authorized representative) will be deemed to confirm that the consignment has been received in good condition.

6. Out of Scope Services

6.1 Non-Standard Deliveries
D4PS Couriers and Logistics Ltd (“the Company”) does not provide delivery services for the following non-standard items or situations:
    • Hazardous or Dangerous Goods: The Company does not transport items classified as hazardous, dangerous, or perishable unless specifically agreed upon in writing and subject to regulatory compliance. This includes, but is not limited to, flammable materials, chemicals, explosives, or any other items regulated under local or international transport laws.
    • Live Animals: The Company does not provide transport for live animals unless otherwise explicitly stated and agreed upon in writing prior to booking.
 6.2 Data Protection

    Collection of Personal Data

    • D4PS Couriers and Logistics Ltd (“the Company”) collects personal data from customers, clients, and users of its services in order to provide courier, logistics, and related services. This may include, but is not limited to, names, addresses, contact details, payment information, consignment details, and other necessary information required to complete the delivery process.
    • The Company collects personal data through various methods, including but not limited to the completion of online booking forms, customer service interactions, and the use of the Company’s website and services.

   Use of Personal Data

      • To process and complete orders and deliveries.
      • To communicate with customers regarding their consignment, order status, or related services.
      • To send invoices, receipts, and payment confirmations.
      • To fulfil legal and regulatory requirements.
      • To improve the quality of the Company’s services and website through feedback and analysis.
      • To provide marketing materials or updates about services, if consent has been provided by the Customer.

    The Company uses personal data for the following purposes:

  • The Company will only use personal data for the purposes outlined above and will not use it for any other purposes without the Customer’s consent.

6.3 Liability & Limitations

We always strive for safe and timely deliveries, but certain situations are beyond our control. We are not responsible for delays or losses caused by:

  • Acts of God (extreme weather, power failures, fuel shortages).
  • War, riots, civil unrest, or strikes.
  • Customs clearance delays or legal restrictions.
  • Improper packaging, incorrect labelling, or recipient unavailability.

7.Loss or Damage Claims

 7.1 Reporting Loss or Damage
  • In the event of damage or loss to a consignment during transit, the Customer must notify D4PS Couriers and Logistics Ltd (“the Company”) in writing as soon as possible, but no later than 7 days from the date of delivery for damaged goods or from the expected delivery date for lost items.
  • Claims must be submitted via the Company’s designated claims process, which can be found on the Company’s website or obtained from customer service. Claims submitted after the specified time frame will not be considered.
  • We are not responsible for indirect losses (e.g., lost business opportunities, missed deadlines, or emotional distress)

8.Unclaimed & Undelivered Goods

8.1 Definition of Unclaimed and Undelivered Goods

For the purposes of this agreement, “unclaimed goods” refers to consignments that the recipient refuses or fails to accept at the time of delivery, and “undelivered goods” refers to consignments that cannot be delivered due to incorrect or incomplete address information, the recipient’s unavailability, or other reasons beyond the Company’s control.

8.2 Disposition of Unclaimed & Undelivered Goods

If unclaimed or undelivered goods are not collected or redelivered within the storage period, (28 days) the Company reserves the right to dispose of or liquidate the goods. The Customer may be charged for any associated costs, including but not limited to storage, disposal, or administrative fees.

The Company will not be liable for any loss, damage, or costs incurred due to the disposal of unclaimed or undelivered goods, nor will it be responsible for returning the goods in the event they are disposed of in accordance with this policy.

9.Governing Law

Applicable Law

These Terms and Conditions, as well as any agreements made between D4PS Couriers and Logistics Ltd (“the Company”) and the Customer, shall be governed by, and construed in accordance with, the laws of United Kingdom, without regard to its conflict of law principles.
